PHOTOGRAPHY AND VIDEO USAGE DISCLAIMER 

The photographs, videos, virtual staged photos, and community photos (collectively referred to as “Visual Content”) produced by Realistic Image LLC (“Company”) are subject to the following terms and conditions: 

  • Ownership and Exclusive Rights: Realistic Image LLC retains all exclusive rights, including copyright and intellectual property rights, to the Visual Content produced. The Visual Content cannot be sold, transferred, or assigned to any entity or individual without the explicit written consent of Realistic Image LLC. 

     

  • Usage Rights Granted: The company or realtor to whom the Visual Content has been sold is granted a non-exclusive, non-transferable license to use the Visual Content for marketing and promotional purposes related to the property depicted in the Visual Content. This license is valid from the date of sale of the Visual Content and continues for a period of 30 days after the property becomes sold or is unlisted. 

     

  • Prohibited Activities: The licensee is prohibited from selling, transferring, assigning, sublicensing, or otherwise distributing the Visual Content to any third party without the prior written consent of Realistic Image LLC. 
  • Realistic Image LLC’s Rights: Realistic Image LLC reserves the right to sell, transfer, assign, sublicense, or distribute the Visual Content to any entity or individual, without limitation. The Visual Content is not the exclusive property of any other entity or individual, except Realistic Image LLC. 

     

  • Limitation of Usage: The license granted to the licensee is limited to the specific property depicted in the Visual Content and for the specified usage period. Any use of the Visual Content beyond the licensed period, property, or purpose requires the written consent of Realistic Image LLC. 

     

  • Modification and Alteration: The licensee is allowed to make modifications to the Visual Content for the purpose of property marketing and promotion. However, modifications that alter the intended context or misrepresent the property are not permitted. 

     

  • Indemnification: The licensee agrees to indemnify and hold Realistic Image LLC harmless from any claims, damages, liabilities, and expenses arising from or related to the use of the Visual Content. 

     

  • Governing Law: This disclaimer and its terms shall be governed by and construed in accordance with the laws of the state where Realistic Image LLC is located. 
  • Entire Agreement: This disclaimer constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties. This disclaimer may not be amended or modified except in writing signed by both parties. 

By purchasing and using the Visual Content produced by Realistic Image LLC, you acknowledge that you have read, understood, and agreed to abide by the terms and conditions outlined in this disclaimer.
